Webkinz T-shirt design CONTEST

CONTEST OPEN TO RESIDENTS OF CANADA AND THE USA (some exclusions apply).

 

These are the official rules (“Rules”) for the Webkinz T-Shirt Design Contest (the “Contest”) which is offered by Ganz (“Sponsor”).  By entering, each entrant (“Entrant”) is deemed to agree with the Rules; do not enter the Contest if you do not agree to Rules.   No purchase is necessary to enter the Contest.

The Contest begins on March 8, 2017 at 9:00 a.m. Eastern Time and ends on April 7,  2017 at 12:00 a.m. Eastern Time (“Contest Submission Period”).

Each Entrant must create an original T-shirt design (“Submission”). All online graphic Submissions must be in either GIF or JPG file formats. The maximum file size allowable per upload is 300K.

There is one Grand Prize available to be won consisting of 60,000 eStore Points.  The approximate retail value of the Grand Prize is $49.99 (CDN).  The odds of winning the Grand Prize depend upon the number and quality of Entries received during the Contest Submission Period. There are nine Runner Up Prizes available to be won consisting of 10,000 eStore Points.  The approximate retail value of the Runner Up Prize is $9.99 (CDN).

To enter online, visit GanzWorld Share Center during the Contest Submission Period and click on the Contest link to register for and enter the Contest.

HOW TO ENTER:

Carefully follow the instructions on the registration page. You must fully complete the registration process and then follow the instructions to upload your original Submission.  Each entry combined with a Submission constitutes an entry (“Entry”) into the Contest.  If you do not have access to the Internet and wish to enter online please inquire with your local library to see if they provide Internet access or visit an Internet Café.

Entries become the property of the Sponsor and none will be returned. Entries will be rejected if Entry is not fully completed, if it is not received by the Sponsor during the Contest Submission Period, or if the Entry does not comply with these Contest Rules, as determined in the sole and final discretion of the Sponsor.

SUBMISSION REQUIREMENTS:

Each Entry must include an original Submission.  By entering the Submission, the Entrant represents and warrants that: (a) the Submission is an original creation of the Entrant and does not include or incorporate, in any manner, any work that was created and/or owned by a third party, other than with all legal consents necessary for the use of such work in connection with the  Entry to this Contest; (b) the Submission is not libelous, defamatory, profane or obscene and does not infringe upon the intellectual property rights, rights of privacy or personality or any other statutory or common law rights of any other person; (c) he/she has obtained the consent of all necessary parties (or their parent or legal guardian of any individual under the age of majority) whose work or image is included in the Submission for it to be included in the Submission, for display to the public online,  for the Entrant to  assign all intellectual property rights in the Submission to the Sponsor, and to waive all moral rights in and to any part of the Submission.   If the Entrant is a child under the age of 18, his or her parent or legal guardian warrants that such parent or legal guardian has read and consents to the Contest Rules before any Submission is sent to Sponsor.

By uploading the Submission, you (and your parents/legal guardians, if you’re under age 18) grant us a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials or incorporate such materials into any form, medium, or technology (now known or later developed or devised) throughout the world. In addition, you waive any “moral rights” in those materials.  You also represent that any materials submitted are original works and do not infringe the rights of any third parties.  You also waive all recourse against the Sponsor, its partners, affiliates, directors, officers, employees, agents and servants, and its advertising and promotional agencies relating to any prize or the Submission or participation in the Contest.

ELIGIBILITY:

This Contest is open to residents of Canada and the USA who have reached the age of majority in their province or territory of residence at the time of Entry.  If the participant is a child under the age of the majority, his or her Entry must be submitted by his/her parent or legal guardian. Residents of the Province of Quebec, States of New York and Florida are excluded from participation in this Contest.

You are not eligible if you are an employee of Sponsor, its partners, affiliates, subsidiaries or related companies, advertising or promotional agencies or a member of the immediate family of any such employee. For these Rules, “immediate family” includes spouse, mother, father, sisters, brothers, sons and daughters, whether living in the same household or not.

GRAND PRIZE:

Delivery of the Grand Prize will be to the Winner’s email address submitted during the registration process, as indicated in his/her Entry, not less than thirty (30) days of being declared a Winner.

The Grand Prize must be accepted as awarded. Sponsor reserves the right in its sole discretion to substitute the Grand Prize or prize component of equal or greater value. The odds of winning the Grand Prize depend upon the number and quality of Entries received during the Contest Submission Period.

WINNER SELECTION:

A panel of judges appointed by the Sponsor (“Judging Panel”) will judge all eligible Submissions on the basis of originality and creativity.  These two criteria will be weighed equally. Odds of an Entry being selected by the Judging Panel will depend on the number and caliber of Entries received. Entries that do not comply with these Rules as determined solely by the Sponsor will be disqualified.

No correspondence will be entered into except with the Winners. The decisions of the Judging Panel are final and binding on all Entrants without right of appeal.

By entering this Contest, each Entrant: (i) grants to the Sponsor the right to use his/her name, mailing address, telephone number, e-mail address and any personal information contained in or related to the Submission (the “Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and publicizing the identity of the Winners; (ii) grants to the Sponsor the right to use his/her Personal Information for any publicity and promotional purposes relating to the Contest or otherwise by the Sponsor, in any and all media now known or hereafter devised, including print, broadcast or the Internet, without further compensation unless prohibited by law; and (iii) acknowledges that the Sponsor may disclose his/her Personal Information to any of its third-party agents or service providers in connection with any of the activities identified in (i) and (ii) above.  The Sponsor will use the Personal Information for identified purposes only and in a manner that is consistent with its Privacy Policy, posted on www.webkinz.com.

By accepting the Grand Prize, each winner (“Winner”) agrees that his/her Submission may be published on a website of the Sponsor and used in any of its future designs, advertising, promotions and public relations initiatives without consent, approval of further compensation.   In addition, each Winner is deemed to agree to the use, without compensation, of his/her image, statements about the Contest, name and city of residence in any publicity campaigns related to the Contest or the Sponsor generally.

If a dispute arises regarding the identity of an Entrant or ownership of a Submission, the Entry will be deemed to be submitted by the authorized account holder of the email address provided at the time of Entry.  “Authorized Account Holder” shall be the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

GENERAL:

Sponsor reserves the right, in its sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest and/or the Rules in any way, at any time, for any reason without prior notice.

By entering this Contest, Entrants acknowledge that all Entries (including all Submissions) become the property of Sponsor and will not be returned.  Sponsor may at its sole discretion select a number of Entries and post them on a website, as is, or as they may be edited in Sponsor’s sole discretion.

The Sponsor assumes no responsibility for incomplete, lost, stolen, delayed, or postage-due Entries or damaged or misdirected entries or for any failure of any website, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any Entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant’s or any other person’s computer related to or resulting from up-loading or down-loading any material in connection with the Contest.

Entries are subject to verification. Entries that are irregular, have been submitted through unapproved means, or which do not otherwise conform with or satisfy any or all conditions of these Rules will be void. By entering, each Entrant agrees to abide by these Rules and the decisions of the Sponsor which shall be final and binding in all matters related to the Contest.

The Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited by law. All issues and questions concerning the Contest, the interpretation of the Contest Rules or the rights and obligations of Entrants and the Sponsor shall be governed and construed in accordance with the laws of the province of Ontario and federal laws applicable therein excluding any rule or principle of conflicts of law that may provide otherwise.  Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Contest may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

All intellectual property, including but not limited to trade marks, trade names, logos, web pages and promotional materials are owned by the Sponsor or its licensors.  All rights are reserved.  Any unauthorized reproduction of any intellectual property without the express written consent of its owner is strictly prohibited.

    Okay, so they’re not going to have a video of some of the pets before the due date come? Last time for the 2017 pet thing, they made a video of some pets.
