Official Rules and Regulations

OPEN ONLY TO RESIDENTS OF THE USA AND CANADA, EXCLUDING THE STATES OF NEW YORK AND FLORIDA, AND THE PROVINCE OF QUEBEC AND IS GOVERNED BY CANADIAN LAW

WEBKINZ NEWZ PEEK-A-NEWZ CHALLENGE:

Find the named Webkinz host on webkinznewz.ganzworld.com 5 times within the identified Promotion Period (the “Challenge”).

HOW TO ENTER:

NO PURCHASE NECESSARY. The Challenge start and end times are listed on the announcement page and constitutes the “Promotion Period.”

During the Promotion Period, visit www.webkinznewz.com and click on the PEEK-A-NEWZ Challenge link to participate. Carefully follow the instructions on the login page. You must complete the login process correctly to participate. You may complete the challenge only once per active Webkinz World Account per Promotion Period.

ELIGIBILITY:

This Challenge is open to holders of active Webkinz World Accounts residing in Canada and the USA, excluding the States of New York and Florida and the Province of Quebec who are of the age of majority in their country, where “age of majority” may be defined as being 18 years of age or older. If you are not yet 18, please ask your parent or legal guardian to review and accept these Rules on your behalf. In these Rules, both the child under the age of 18 and his/her parent/legal guardian are referred to as “you”.

You are not eligible to participate in the Challenge if you are

(i) an employee of Ganz (the “Sponsor”),

(ii) an employee of one of its affiliates or subsidiaries,

(iii) an employee of any of the Sponsor’s advertising or promotional agencies, or

(iv) if you are a member of the immediate family of any such person. In these Rules, “immediate family” means spouse (including “common law”), mother, father, sister, brother, son or daughter.

PRIZES:

When you complete the Challenge within the Promotion Period, you will receive a virtual prize (the “Prize”). Each Prize will be delivered to its winner within twenty four (24) hours of all requirements of these Rules being met. The Prizes must be accepted as awarded. The Sponsor reserves the right for any reason in its sole discretion, to substitute a Prize or Prize component of equal or greater value. Maximum one Prize per valid Webkinz World Account per Promotion Period.

WINNER SELECTION:

1. A Prize will be awarded to every participant who completes the Challenge. The Prize will be added to the participant’s Webkinz World account within 24 hours of such participant successfully completing the Challenge.

2. Each participant further agrees to be bound by decisions of the Sponsor which shall be final and binding in all respects, with no right of appeal. In addition, this Challenge is subject to all applicable federal, provincial/state and municipal laws and regulations. Void where prohibited by law. Sponsor reserves the right to amend these Rules or terminate the Challenge for any reason, at any time, in its sole discretion. All issues concerning the validity, interpretation or enforceability of these Rules or the rights and obligations of the Sponsor and the participant shall be determined in accordance with the laws of the Province of Ontario and federal law applicable therein without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. Any attempt to deliberately damage any web site, gain access to the Challenge in a fraudulent manner, or to undermine the legitimate operation of this Challenge may be a violation of the Sponsor’s User Agreement, criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

GENERAL:

3. Each submitted Webkinz World Account will be deemed to be submitted by the authorized account holder of the Webkinz World account provided at the time of submission. The Sponsor assumes no responsibility for incomplete, lost, delayed, or misdirected submission or for any failure of any e-mail service or website during the Promotional Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any submission to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to a participant’s or any other person’s computer related to or resulting from up-loading or down-loading any material in the Challenge. Submission that are irregular, have been submitted through any method other than as described herein or which do not otherwise conform with or satisfy any or all conditions of these Rules will be determined to be void.

4. No Promotion correspondence will be entered into except with the participants who completed the Challenge successfully.
