Million Points Giveaway

February 19 – March 3, 2016

OPEN TO RESIDENTS OF CANADA AND THE USA (some exclusions apply).

1. These are the official rules (“Rules”) for the ‘Million Point Giveaway’ Promotion (the “Promotion”) which is offered by Ganz (“Sponsor”).  By entering, each entrant (“Entrant”) is deemed to agree with the Rules.
2. The Promotion begins on February 19, 2016 at 9:00 a.m. Eastern Time and ends on March 3, 2016 at 11:59 p.m. Eastern Time (“Promotion Period”).
3. NO PURCHASE NECESSARY: Enter by emailing Millionpoints@ganz.com and including the phrase ‘Million Points Giveaway’ in the subject line. Emails must be received no later than 11:59pm Eastern Time on March 3, 2016. Limit of one entry per email account per Promotion Period. Participants who, during the Promotion Period, purchased Deluxe Membership upgrades at http://www.ganzestore.com/estore/membership/catalog/Deluxe%20Membership?productsSize=15shall automatically receive 5 additional entries for each month of purchased upgrade. at .
   1. There are 20 prizes to be won (each, a “Prize”) totaling 1,000,000 Ganz eStore Points, namely:

One (1) Grand Prize – 250,000 Ganz eStore Points,
Three (3) First Prizes, each consisting of 100,000 Ganz eStore Points,
Six (6) Second Prizes, each consisting of 50,000 Ganz eStore Points,
Five (5) Third Prizes, each consisting of 20,000 Ganz eStore Points,
Five (5) Third Prizes, each consisting of 10,000 Ganz eStore Points.

The approximate retail value of the Prizes is as follows: Grand Prize – $250.00 (CAD), First Prize – $100.00 (CAD) each, Second Prize – $50.00 (CAD) each, Third Prize – $20.00 (CAD) each, Fourth Prize – $10.00 (CAD) each.  The odds of winning a Prize depend on the number of Entries received during the Promotion Period.

HOW TO ENTER:

Receive a FREE entry and a copy of the Rules, by emailing Millionpoints@ganz.com and including the phrase ‘Million Points Giveaway’ in the subject line. Emails must be received no later than 11:59 pm March 3, 2016. Limit of one entry per email account per Promotion Period. Additional entries are available to Ganz eStore customers who purchase Deluxe Membership upgrades at http://www.ganzestore.com/estore/membership/catalog/Deluxe%20Membership?productsSize=15, at five (5) entries per each purchased month of Deluxe upgrade. Participants will receive five entries for every month of Deluxe Membership purchased. A 12 Month Deluxe Membership purchase qualifies Entrant for sixty (60) Entries, a Three Month Deluxe Membership purchase qualifies Entrant for fifteen (15) Entries, and a One Month Deluxe Membership purchase qualifies Entrants for five (5) entries.  One free Entry per email account per Promotion Period.   Ganz eStore customers purchasing monthly Deluxe Membership upgrades shall receive five (5) entries for each month of Deluxe upgrade purchased.  Ganz is not responsible for late, lost, misdirected, or invalid Entries. Entries will be deemed to have been submitted by the person registered to the account from which entries are received. Once you submit your Entry, you will be officially entered into the Promotion. Entries cannot be revised or altered once submitted. Automated means of entry and entries by any means which subvert the entry process are prohibited and all such entries will be void.

ELIGIBILITY:

This Promotion is open to residents of Canada and the USA who have reached the age of majority in their State, Province or territory of residence at the time of Entry.  If the participant is a child under the age of majority, his or her Entry must be submitted by his/her parent or legal guardian. Residents of the Province of Quebec, States of New York and Florida are excluded from participation in this Promotion. You are not eligible if you are an employee of Sponsor, its partners, affiliates, subsidiaries or related companies, advertising or promotional agencies or a member of the immediate family of any such employee. For these Rules, “immediate family” includes spouse, mother, father, sisters, brothers, sons and daughters, whether living in the same household or not.

GRAND PRIZE:

Delivery of the Prizes will be by April 30, 2016 to the email address associated with the Ganz eStore account provided by the winner or to the email address associated with the Ganz eStore account used to purchase the qualifying Deluxe Membership.

WINNER SELECTION:

By entering this Promotion, each Entrant: (i) grants to the Sponsor the right to use his/her name, mailing address, telephone number, e-mail address and any personal information contained in or related to the Submission (the “Personal Information”) for the purpose of administering the Promotion, including but not limited to contacting and publicizing the identity of the Winners; (ii) grants to the Sponsor the right to use his/her Personal Information for any publicity and promotional purposes relating to the Promotion or otherwise by the Sponsor, in any and all media now known or hereafter devised, including print, broadcast or the Internet, without further compensation unless prohibited by law; and (iii) acknowledges that the Sponsor may disclose his/her Personal Information to any of its third-party agents or service providers in connection with any of the activities identified in (i) and (ii) above.  The Sponsor will use the Personal Information for identified purposes only and in a manner that is consistent with its Privacy Policy, posted on Webkinz Newz[o1] .

All eligible Entries will be entered into the Prize draw, which will occur on March 7, 2016 (the “Draw Date”) in Toronto, Ontario at approximately 11:00 a.m. On the Draw Date, twenty (20) eligible entrants will be selected by random draw from among all eligible Entries received in accordance with these Rules.  Limit of one prize per winning Entrant.

The Sponsor will make a maximum of three (3) attempts to contact each selected Entrant (using only the information provided at the time of Entry) within twenty (20) business days of the Draw Date. If a selected Entrant cannot be contacted within three (3) attempts or twenty (20) business days of the Draw Date (whichever occurs first), or if there is a return of any notification as ‘undeliverable’, then that selected Entrant will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate Winner from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected Winner).

Before being declared a Prize Winner, each selected Entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return within ten (10) business days of notification the Sponsor’s declaration and release form.  If a selected Entrant: (a) fails to correctly answer the skill-testing question; and/or (b) cannot accept the Prize as awarded (for any reason); then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible Entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected Entrant).

If a dispute arises regarding the identity of an Entrant or ownership of an Entry, the Entry will be deemed to be submitted by the authorized holder of the email address associated with the eStore account through which the Deluxe Membership was purchased, or, for emailed entries the email address used at the time of Entry.  “Authorized Account Holder” shall be the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

GENERAL:

Sponsor reserves the right, in its sole discretion, to terminate the Promotion, in whole or in part, and/or modify, amend or suspend the Promotion and/or the Rules in any way, at any time, for any reason without prior notice.

The Sponsor assumes no responsibility for incomplete, lost, stolen, delayed, or postage-due Entries or damaged or misdirected Entries or for any failure of any website, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any Entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant’s or any other person’s computer related to or resulting from up-loading or down-loading any material in connection with the Promotion.

Entries are subject to verification. Entries that are irregular, have been submitted through unapproved means, or which do not otherwise conform with or satisfy any or all conditions of these Rules will be void. By entering, each Entrant agrees to abide by these Rules and the decisions of the Sponsor which shall be final and binding in all matters related to the Promotion.

The Promotion is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited by law. All issues and questions concerning the Promotion, the interpretation of the Rules or the rights and obligations of Entrants and the Sponsor shall be governed and construed in accordance with the laws of the Province of Ontario and federal laws applicable therein excluding any rule or principle of conflict of laws that may provide otherwise.  Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

All intellectual property, including but not limited to trade marks, trade names, logos, web pages and promotional materials are owned by the Sponsor or its licensors.  All rights are reserved.  Any unauthorized reproduction of any intellectual property without the express written consent of its owner is strictly prohibited.
