Happy Holiday Giveaway Official Rules

OPEN TO RESIDENTS OF CANADA AND THE USA (some exclusions apply).

1. These are the official rules (“Rules”) for the Happy Holiday Giveaway (the “Giveaway”) which is offered by Ganz (“Sponsor”).  By entering, each entrant (“Entrant”) is deemed to agree with the Rules.  NO PURCHASE IS NECESSARY TO ENTER.
2. The Giveaway begins on November 1, 2016 at 9:00 a.m. Eastern Time and ends on November 15, 2016 at 11:59 p.m. Eastern Time (“Giveaway Period”).  NO PURCHASE NECESSARY TO PLAY: Receive a FREE entry and/or a copy of the official rules, by emailing happyholidays@ganz.com and including the phrase ‘Happy Holiday Giveaway’ in your subject line (each, an “Entry”). Emails must be received no later than 11:59pm Eastern Time on November 15, 2016. Limit of one Entry per email account. Participants may also enter by purchasing a Deluxe Membership at http://www.ganzestore.com/estore/membership/catalog/Deluxe%20Membership?productsSize=15. Participants will receive five Entries for every month of Deluxe Membership purchased (e.g. a 12 Month Deluxe Membership equals 60 Entries, a Three Month Deluxe Membership equals 15 Entries, and a One Month Deluxe Membership equals five Entries).

There are 40 prizes to be won (each, a “Prize”) consisting of:

One (1) Grand Prize

Three (3) First Prizes

Each First Prize includes virtual items: 6x 2016 Fall Super Mystery Bags, 4x 2016 Fall Mystery Clothing Bag, 1x Surprising Storage (tradeable).
Six (6) Second Prizes

Each Second Prize includes virtual pet and items: Autumn Waterfall (Tradeable), Harvest Sheep, Autumn Wallpaper, Fall Frenzy Trampoline, Garden Candle Lantern, Fall Garden Bench, Fall Season Window, Autumn Stained Glass Window, Prize Winning Chili Pot, Ombre Autumn Dress.

Ten (10) Third Prizes, each consisting of one virtual WEBKINZ Autumn Owl and Acorn 4×4 Set.

Twenty (20) Fourth Prizes, each consisting of one virtual WEBKINZ Cairn Terriers.

The approximate retail value of the Prizes is as follows: Grand Prize – $179.99 (CAD), First Prize – $59.99 (CAD) each, Second Prize – $39.99 (CAD) each, Third Prize – $12.50 (CAD) each, Fourth Prize – $10.00 (CAD) each.  The odds of winning a Prize depend on the number of Entries received during the Giveaway Period.

HOW TO ENTER:

1. Receive a FREE entry and/or a copy of the official rules, by emailing happyholidays@ganz.com and including the phrase ‘Happy Holiday Giveaway’ in the subject line (each, an “Entry”). Emails must be received no later than 11:59 pm November 15, 2016. Limit of one Entry per email account. Participants may also enter by purchasing a Deluxe Membership at http://www.ganzestore.com/estore/membership/catalog/Deluxe%20Membership?productsSize=15. Participants will automatically receive five Entries for every month of Deluxe Membership purchased. A 12 Month Deluxe Membership purchase qualifies Entrant for sixty (60) Entries, a Three Month Deluxe Membership purchase qualifies Entrant for fifteen (15) Entries, and a One Month Deluxe Membership purchase qualifies Entrants for five (5) Entries.
2. One free Entry per email account per Giveaway. Entries received with the purchase of the Deluxe WEBKINZ Membership are limited to the number of Deluxe Memberships purchased multiplied by the number of months per purchased Deluxe Membership.  Ganz is not responsible for late, lost, misdirected, or invalid Entries. Entries will be deemed to have been submitted by the person registered to the account from which Entries are received. Once you submit your Entry, you will be officially entered into the Giveaway. Entries cannot be revised or altered once submitted. Automated means of entry and Entries by any means which subvert the entry process are prohibited and all such Entries will be void.

ELIGIBILITY:

1. This Giveaway is open to residents of Canada and the USA who have reached the age of majority in their province or territory of residence at the time of Entry.  If the participant is a child under the age of the majority, his or her Entry must be submitted by his/her parent or legal guardian. Residents of the Province of Quebec, States of New York and Florida are excluded from participation in this Giveaway.
2. You are not eligible if you are an employee of Sponsor, its partners, affiliates, subsidiaries or related companies, advertising or Giveawayal agencies or a member of the immediate family of any such employee. For these Rules, “immediate family” includes spouse, mother, father, sisters, brothers, sons and daughters, whether living in the same household or not.

GRAND PRIZE:

1. Delivery of the Grand Prize will be to the email address provided by the winning Entrant by December 30, 2016.   Delivery of the First, Second, Third and Fourth Prizes will be to the email address provided by the Entrant on the Free Entry form, or to the email address associated with the eStore account used to purchase the qualifying Deluxe Membership.
2. The Grand Prize must be accepted as awarded. Sponsor reserves the right in its sole discretion to substitute the Grand Prize for prize component of equal or greater value.

WINNER SELECTION:

1. By entering this Giveaway, each Entrant: (i) grants to the Sponsor the right to use his/her name, mailing address, telephone number, e-mail address and any personal information contained in or related to the Submission (the “Personal Information”) for the purpose of administering the Giveaway, including but not limited to contacting and publicizing the identity of the Winners; (ii) grants to the Sponsor the right to use his/her Personal Information for any publicity and Giveawayal purposes relating to the Giveaway or otherwise by the Sponsor, in any and all media now known or hereafter devised, including print, broadcast or the Internet, without further compensation unless prohibited by law; and (iii) acknowledges that the Sponsor may disclose his/her Personal Information to any of its third-party agents or service providers in connection with any of the activities identified in (i) and (ii) above.  The Sponsor will use the Personal Information for identified purposes only and in a manner that is consistent with its Privacy Policy, posted on Webkinz Newz.
2. All eligible Entries will be entered into the Prize draw, which will occur on November 18, 2016 (the “Draw Date”) in Toronto, Ontario at approximately 11:00 a.m. On the Draw Date, forty (40) eligible entrants will be selected by random draw from among all eligible Entries received in accordance with these Rules. Limit of one prize per winning entrant.
3. The Sponsor will make a maximum of three (3) attempts to contact each selected Entrant (using only the information provided at the time of Entry) within twenty (20) business days of the Draw Date. If a selected Entrant cannot be contacted within three (3) attempts or twenty (20) business days of the Draw Date (whichever occurs first), or if there is a return of any notification as undeliverable, then that selected Entrant will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible Entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected Entrant).
4. Before being declared a Prize Winner, each selected Entrant will be required to: sign and return within ten (10) business days of notification the Sponsor’s declaration and release form.  If a selected Entrant cannot accept the Prize as awarded (for any reason); then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible Entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected Entrant).
5. If a dispute arises regarding the identity of an Entrant or ownership of an Entry, the Entry will be deemed to be submitted by the authorized holder of the email address associated with the eStore account through which the Deluxe Membership was purchased, or, for emailed Entries the email address used at the time of Entry.  “Authorized Account Holder” shall be the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

GENERAL:

1. Sponsor reserves the right, in its sole discretion, to terminate the Giveaway, in whole or in part, and/or modify, amend or suspend the Giveaway and/or the Rules in any way, at any time, for any reason without prior notice.
2. By entering this Giveaway, Entrants acknowledge that all Entries become the property of Sponsor and will not be returned.  Sponsor may at its sole discretion select a number of Entries and post them on a website, as is, or as they may be edited in Sponsor’s sole discretion.
3. The Sponsor assumes no responsibility for incomplete, lost, stolen, delayed, or postage-due Entries or damaged or misdirected Entries or for any failure of any website, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any Entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant’s or any other person’s computer related to or resulting from up-loading or down-loading any material in connection with the Giveaway.
4. Entries are subject to verification. Entries that are irregular, have been submitted through unapproved means, or which do not otherwise conform with or satisfy any or all conditions of these Rules will be void. By entering, each Entrant agrees to abide by these Rules and the decisions of the Sponsor which shall be final and binding in all matters related to the Giveaway.
5. The Giveaway is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited by law. All issues and questions concerning the Giveaway, the interpretation of the Rules or the rights and obligations of Entrants and the Sponsor shall be governed and construed in accordance with the laws of the province of Ontario and federal laws applicable therein excluding any rule or principle of conflicts of law that may provide otherwise.  Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Giveaway may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
6. All intellectual property, including but not limited to trademarks, trade names, logos, web pages and promotional materials are owned by the Sponsor or its licensors.  All rights are reserved.  Any unauthorized reproduction of any intellectual property without the express written consent of its owner is strictly prohibited.
